Kuwait Court of Cassation principle number 375

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

No one other than the judges who heard the oral arguments may participate in rendering the judgment, whether by deliberating on it or signing its draft. An impediment affecting one of them and another replacing him. He must sign the draft judgment, and this must be recorded in the judgment document; otherwise, it is affected by nullity relating to public policy. Contravention of this vitiates the judgment and requires its cassation. Example. - 78 - Civil Procedure
