English translation of the principle
A suspensive condition. That upon whose fulfilment the existence of the obligation depends. - A suspensive condition dependent on the will of one party to the obligation and the will of a third party. A valid condition. - The existence of the obligation during the period of its suspension is uncertain. The effect of this is to prohibit the creditor from taking enforcement measures to obtain his right compulsorily so long as the condition has not been fulfilled.

الشرط الواقف. ما يتوقف وجود الالتزام على تحققه. - الشرط الواقف المعلق على إرادة أحد طرفي الالتزام وإرادة الغير. شرط صحيح. - وجود الالتزام أثناء فترة تعليقه يكون وجوداً غير مؤكد. أثر ذلك حظر اتخاذ الدائن لوسائل التنفيذ لاقتضاء حقه جبراً طالما لم يتحقق الشرط.Original Arabic judgment citations
