Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4010

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Recourse to the judge of interim matters for precautionary attachment of the debtor’s movables and his assets held by third parties. Permissible even if the debt is not quantified, whenever the creditor fears losing the security for his right, with the debt being provisionally assessed. - A dispute over the debt does not prevent it from being considered certain in existence and attachment being imposed on its basis, whenever it is established on an apparent basis and the dispute over it is not genuine. - Assessment of the genuineness of the dispute over the debt for which attachment is imposed. A matter of fact for the court hearing the merits. Its condition. - 700 - Civil Procedure - The debtor’s bringing an action for appointment of an expert to settle the account. Does not preclude precautionary attachment of his assets. A judgment to the contrary. Contradiction of what is established in the papers and flawed inference requiring its cassation.
