Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4116

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The travel ban order remains effective until the debt is extinguished by payment or release. Exception: the debtor deposits with the treasury of the Enforcement Department a sum of money equal to the debt and its accessories, allocated to satisfying the right of the creditor who obtained the order. The effect resulting from that deposit: the Department is obliged to take the requisite measures, including lifting the travel ban order. Its failure to do so gives rise to liability for any resulting damage.
