State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that a lawyer is an agent whose relationship with his client is governed by the general law provisions concerning the relationship between principal and agent. The provision in Article 32 of Law No. 42 of 1964 concerning the legal profession empowering the judge to assess the lawyer’s fees if the client disputes them. The issuance of Law 62 of 1996 and its exclusion of the provision in the previous law concerning assessment of the lawyer’s fees where they are disputed means that the legislature intended to leave this matter to the provisions of general law, namely the Civil Code provisions on agency, because no conflict exists. Example. - 730 - Civil Procedure
