State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Nullity of a statement of claim, appeal pleading or petition if not signed by a lawyer admitted before the court to which it is submitted. The legislature permits this nullity to be cured even after it has been invoked, by a lawyer signing the pleading after its submission. Condition thereof: this must occur at the same level of litigation and within the prescribed time limit, if any. Example. - Absence of a lawyer's signature on the originating statement of claim and the pleading amending the claims, and the court's enabling the litigant to obtain a lawyer's signature on both. Its effect: curing the nullity arising from the absence of a signature on the two pleadings. A ruling rejecting the plea of their nullity. Correct in accordance with the law.
