Kuwait Court of Cassation principle number 4262
State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
What the Lawyers’ Disciplinary Board issues concerning a lawyer referred to it. A judgment, not an administrative decision. The reason: the legislature conferred upon it the nature and characteristics of a judgment by making the judicial element predominant in its composition at the first stage, constituting its appellate formation of members of the judiciary with no participation by others, vesting prosecutorial authority in the Public Prosecution, and regulating the procedures for hearing matters brought before the Board at both levels in a manner ensuring that the lawyer is informed of the allegations against him and the hearings at which the matter is considered, enabling the lawyer to present his defence, establishing the right to lodge an opposition against the decision issued against him, permitting the Public Prosecution and the lawyer to appeal the decision, and specifying the period within which this is permissible. Its implication. The legislature has assimilated a decision of conviction or acquittal to judgments, and it is not considered an administrative decision.

Original Arabic judgment citations
