Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 432

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

For an appeal to be admissible, judgment must have been rendered against the appellant. An appeal or ground of challenge is inadmissible where its proponent has no interest in it whereby it would lead to reversal of the judgment or its amendment to a legal position distinct from that adjudged. A merely theoretical interest is insufficient. - The judgment's adjudication is not its operative part alone, but the actual conclusive determination of the dispute or part of it, wherever located in the reasons or operative part.
