Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4330

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that the plaintiff assesses the value of the disputed property in the action he brings concerning it. Exception for actions subject to the provisions of Law No. 33 of 2000 concerning claims to ownership of State real property. The value of the property must be determined by an expert appointed by the court for that purpose. The Director of the Judicial Fees Department may take appropriate measures to achieve this, including seeking assistance from whomever he considers suitable to assess its value in actions adjudicated without the court assessing their value. The basis for this.
