State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Assessment of the value of an action under the provisions of the Code of Procedure. Its difference from assessment under the provisions of Law 17 of 1973 concerning Judicial Fees. The latter contains provisions regulating how the value of certain actions is assessed and treats an action whose value cannot be assessed as an action of unassessed value. Its provisions must be adhered to in disputes in which a controversy arises over the judicial fees payable thereon. Its lack of regulation of how to assess the value of an incidental indemnity action where the claimant seeks an award of whatever may be awarded against him in the principal action. The action must in this case be treated as one of unassessed value. The fee collected for it is a fixed fee. Article 7 of the aforementioned Law.
