Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 4382

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Filing the statement of claim or application is the event giving rise to the right to collect judicial fees, and the claimant is obliged to pay them regardless of the court’s ultimate ruling on the costs of the action under the Code of Procedure. The Court Registry may demand them from the claimant or an intervenor asserting an independent claim in all cases, and they may not be demanded from the defendant unless he is ordered to pay the litigation costs.
Arabic original
