Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 499

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A plea of inadmissibility is a matter preliminary to determination of the merits. Whenever the court considers joining them together, it must alert the litigants to present their defence on the merits of the litigation. And it must give reasons for each without any particular order being required.
Arabic original
