Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 730

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judicial admission. Its nature. What a litigant states on the cover of a bundle of documents. It does not constitute an admission. A judgment's failure to respond to the defense concerning this. It does not vitiate it where it upholds the ruling of the court of first instance for its reasons. The reason therefor: following the litigants through their statements, arguments and requests and responding thereto separately is unnecessary. An implicit response suffices.
