Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 76

State of Kuwait · Pleadings — Part Three · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The agency contract. The principal's authorisation of the agent to appoint a substitute without specifying his identity. The agent is liable only for his fault in selecting his substitute, his fault in the instructions he issued to him, or his negligence in supervising and directing him in performing the agency. His liability on the basis of this fault derives from the law, not contractual liability for another. The original principal and the substitute agent may each bring a direct action against the other demanding performance of his obligations towards the agent. The source of each one's obligation towards the other is the direct action. The legislature's departure from the general rule in these two cases. The basis thereof. Article 710 of the Civil Code. Example.
