Kuwait Court of Cassation principle number 136
State of Kuwait · Recent Criminal Matters ·
English translation of the principle
Summary: - A request for time to inspect and present the defence. Does not constitute a defence or plea. Granting or refusing it falls within the court’s unfettered discretion. Failure to grant it does not vitiate the judgment. Rule: Defence counsel’s request on behalf of the appellant for an adjournment to inspect and present the defence does not constitute a plea or defence put before the court, but falls within its unfettered discretion to grant or refuse. Accordingly, it cannot be faulted for not granting it, and the appellant’s challenge in that regard is unsound.

Original Arabic judgment citations
