English translation of the principle

Summary: - Mental illness and equivalent conditions which exclude criminal responsibility are those capable of eliminating awareness or resulting in loss of the ability to direct the will generally. Other illnesses and psychological conditions which diminish or weaken these two faculties without reaching the point at which a person loses all awareness or will. Do not constitute a ground for excluding responsibility. - The appellant’s objection concerning the negation of his criminal responsibility because he suffers from episodes depriving him of the ability to exercise control before and during the incident. A manifestly invalid legal defence. The court is not at fault for disregarding it. Rule: It is established—as consistently held by the Court of Cassation—that mental illness and equivalent conditions which exclude criminal responsibility are those capable of eliminating awareness or resulting in loss of the ability to direct the will generally. Other illnesses and psychological conditions which diminish or weaken these two faculties without reaching the point at which a person loses all awareness or will do not constitute a ground for excluding responsibility. Accordingly, the appellant’s objection concerning the absence of his criminal responsibility because he suffers from episodes depriving him of the ability to exercise control before, during and after the incident is a manifestly invalid legal defence, and the court is not at fault for disregarding it.
