Summary: - Publication offenses are not offenses in which settlement or an individual pardon by the victim is permissible. Consequence: A waiver by the victim of his rights in publication offenses has no effect on the criminal proceedings. Rule: Since the offense of which the first appellant was convicted—publishing news containing an affront to the dignity of the victim ...............—and that of which the second appellant was convicted—authorizing publication of the press report constituting the aforementioned offense without ascertaining its accuracy and truth—are not among the offenses exhaustively specified in Article 240 of the Criminal Procedure and Trials Law in which settlement or an individual pardon by the victim is permissible, the waiver issued by the victim to the first appellant of his rights in the present proceedings—and submitted by the first appellant to this Court, the Court of Cassation—has no effect on the criminal proceedings and is therefore inadmissible.
