English translation of the principle

Summary: - Obedience to a superior does not under any circumstances extend to committing crimes. A subordinate is not required to obey his superior’s order to commit an act which he knows is punishable by law. Attempted appropriation of public funds is an unlawful act in which criminal intent is clear. The appellant’s complaint that he committed this act in compliance with his superior’s order is a manifestly invalid defence that warrants no response. Rule: It is established that obedience to a superior does not under any circumstances extend to committing crimes, and that a subordinate is not required to obey an order from his superior to commit an act which he knows is punishable by law. The attempted appropriation of public funds with which he was charged and of which the court convicted him is an unlawful act in which criminal intent is clear. The appellant cannot therefore properly claim that he was compelled to commit the offence in compliance with his superior’s order at work, in respect of the instructions and orders issued. Accordingly, what the appellant raises in this regard is no more than a manifestly invalid legal defence that warrants no response from the court.
