English translation of the principle
Summary: - Methods to be followed in serving documents in criminal matters. Articles 16, 17, 18, 19 and 20 of the Code of Criminal Procedure and Trials. - Service of the order to appear—the summons—on the person required to appear, if possible, delivery of the copy to him, and his signature on the reverse of the other copy. Purpose of the signature: to serve as evidence of delivery of the document at his residence to an adult male relative residing with him. Article 17 of the Code of Criminal Procedure and Trials. - The person effecting service must return to the person issuing the order his copy signed by the recipient of service or the witnesses, bearing the server’s signed declaration stating the date, place and manner of service and everything that occurred. It constitutes testimony by him and has evidentiary force until the contrary is established. Article 19 of the Code of Criminal Procedure and Trials. Rule: The legislature—as established by this Court’s case law—through Articles 16, 17, 18, 19 and 20 of the Code of Criminal Procedure and Trials, prescribed the methods to be followed in serving documents in criminal matters, including the summons requiring the accused to attend the trial hearing. Article 17 provides that the order to appear shall be served on the person required to appear, if possible, that a copy shall be delivered to him, and that he shall sign the reverse of the other copy. By this signature, the legislature intended evidence of delivery of the document at his residence to an adult male relative residing with him. Article 19 of the same Code also provides that the person effecting service must return to the person issuing the order his copy signed by the recipient of service or the witnesses, bearing a declaration signed by the server stating the date, place and manner of service and everything that occurred in connection therewith that is material for the person issuing the order to know. This declaration constitutes testimony by the server, and its contents have evidentiary force until the contrary is established. Inspection of the original summons requiring the first appellant to attend the hearing of 8/2/2012, at which his appeal was heard and the case reserved for judgment—attached to the joined case papers—establishes that it was directed to his residence specified in the papers and, owing to his absence, was delivered to his brother residing with him, who signed the copy acknowledging receipt, in accordance with the aforementioned Article 17. Accordingly, the contents of the service document have evidentiary force, and the appellant did not establish the contrary or dispute delivery of the document at his residence to his adult brother. Moreover, the record of the appellate trial hearing establishes that a lawyer attended on the appellant’s behalf and did not raise the issue of failure to serve him with notice of the hearing or request adjournment of the case to complete this procedure. The first appellant was therefore validly and lawfully served with notice of the hearing at which his appeal was heard, in the manner prescribed by law, and his objection in this regard is unfounded.
