English translation of the principle

Summary: - The accused’s right to be accompanied by his lawyer in all preliminary investigation procedures. The condition: that he initially declare his lawyer’s name and his wish for him to attend the investigation. Failure to satisfy these two conditions. Its effect. No basis for his plea that the investigation is invalid. Rule: It is established, in principle, that the accused has the right to be accompanied by his lawyer when attending all preliminary investigation procedures, but this requires the accused initially to declare his lawyer’s name and his wish for him to attend the investigation with him, disclosing his capacity and his wish for his attendance. Since the appellant did not claim that either matter had occurred, his plea that his interrogation was invalid because his lawyer was not invited to attend the Public Prosecution’s investigation with him is unsound.
Arabic original
