Kuwait Court of Cassation principle number 80

English translation of the principle

Summary: - The challenged judgment did not rely on police inquiries; the expressions it quoted from the witness were merely part of his testimony in which it had confidence, without the inquiries themselves constituting independent evidence. An objection to this has no basis. Rule: The reasoning of the challenged judgment establishes that it did not rely in its ruling on police inquiries. The expressions the judgment quoted from the officer involved in the incident in this regard were merely part of his testimony—which the court recited after expressing its confidence in it. Those inquiries do not, in themselves, constitute independent evidence, and the judgment did not rely on them as such. Accordingly, the two appellants' objection in this respect has no basis.
