English translation of the principle

Summary: - Interpretative legislation. Does not repeal the earlier legislation which it interprets. Reason. It is not new legislation so long as it sets out the legislature's intent in the earlier legislation, and is deemed to have been enacted together with the legislation it interprets. Consequence. It applies to cases not yet determined, without this having any retroactive effect. Rule: It is established that interpretative legislation does not repeal the earlier legislation which it interprets, since it is not new legislation so long as it clarifies the legislature's purpose in the earlier legislation. As such, it is deemed to have been enacted together with the legislation it interprets, and thus applies to cases not yet determined, without this having any retroactive effect.
