State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Fraud by the debtor is insufficient for his disposition to be ineffective against the creditor. The creditor must prove collusion between the debtor and the transferee to harm him. The basis for this. - The creditor’s proof of the debtor’s knowledge of his insolvency. A presumption of fraud on the debtor’s part, meaning that he did not intend to harm the creditor, and the transferee may prove that the debtor did not intend to harm him.
