Kuwait Court of Cassation principle number 2282
State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The agreement made between the stipulator and the beneficiary governs their relationship in a stipulation for the benefit of a third party. If the agreement is a gift, the beneficiary is not obliged to render anything to the stipulator; but if it is for consideration, he is obliged to render the agreed consideration to him. Example of the parties agreeing that the beneficiary pay the price of the car to the stipulator, so that the car is for consideration and not a gift.
Arabic original
Original Arabic judgment citations
