State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The Economic Agreement between the Gulf Cooperation Council States, approved by the State of Kuwait by Law 5 of 2003. It accorded equal treatment to the nationals of these States in all economic fields. The implication of this. Nationals of those States signatory to the Agreement may practise all economic, investment, and service activities, including engaging in commerce within Kuwait, individually and without being required to enter into a partnership with a Kuwaiti national, as an exception to the general rule established in Article 23 of the Commercial Code. The reason for this. Priority in application is given to the provisions of this Agreement when they conflict with the domestic laws and regulations of the member States. Article 32/1 of the Agreement. An example concerning the entitlement of nationals of the Kingdom of Saudi Arabia to practise commercial activity individually within Kuwait.
