Absence of cause. Its effect. Absolute nullity of the disposition. - The cause of a release is donative intent. The existence of this intent on the part of an injured person towards the insurance company is inconceivable. Therefore, an injured person's release of the insurance company from the compensation due to him is without cause and absolutely void.

تخلف السبب. أثره. بطلان التصرف بطلاناً مطلقاً. - السبب في الإبراء هو نية التبرع. قيام هذه النية لدى مصاب تجاه شركة التأمين غير متصور. لذلك، فإن إبراء المصاب لشركة التأمين من التعويض المستحق له يكون بدون سبب وباطل بطلاناً مطلقاً.Original Arabic judgment citations
