State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The nullity of a contract concluded by a non-Kuwaiti pursuant to the prohibition contained in the Commercial Code does not preclude him from claiming his rights on another legal basis. - Permissibility of changing the cause while retaining the subject matter of the original claim. - Nullity extinguishes the contract with effect dating back to the time of its conclusion. Every effect of its performance ceases if it has been performed. Consequence thereof. Restoring everything to its original state and each contracting party recovering what he gave if restitution in kind is impossible. Equivalent performance may be awarded. - 485 - Commercial
