Leasing it together with its tangible and intangible components is deemed a sale of the business. Condition thereof. - Determining whether the elements of the business to which the sale relates constitute essential elements of the commercial business, making its sale a sale of a commercial business, or are non-essential. Within the authority of the court of merits. Condition thereof. - Characterizing whether the sale is a sale of a commercial business or a sale of some of its non-essential elements. A question of law subject to review by the Court of Cassation.
