Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 3352

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Statutory interest accrues on the balance debt from the date the account is closed unless otherwise agreed, and it becomes an ordinary debt not subject to interest at the banking rate that applied to its individual entries while it was operating. Rather, the rate the parties agree to apply upon closing the account applies to it; otherwise, interest is calculated on the basis of 7%, the statutory rate.
