Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 362

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Management of common property belongs to the manager whose appointment is agreed upon by those owning the majority of the shares. - Their failure to appoint a manager and the performance by one co-owner alone of one of those acts. Its effect: he is deemed, in what he has done, to be the representative of all. The condition therefor: the majority does not object within an appropriate time. - The bringing by one co-owner in undivided ownership of an action to vacate and deliver the premises. Its inclusion within management of the common property and its sufficiency to establish his standing to bring it. A judgment's contravention of this. An error in the application of the law requiring its cassation.
