The aval guarantor. A surety jointly and severally liable with the debtor, both being liable to the holder for the value of the instrument. Consequence: he cannot oppose the holder’s claim by invoking excussion or division, and the holder has unconditional recourse against him. - Recourse by each of the original principal and the sub-agent against the other:-
