Kuwait Court of Cassation principle number 4287
State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office
English translation of the principle
The parties to an employment contract may agree to reduce the worker’s wage, whether by amending an existing contract or concluding another contract. Its implication. The employer is bound by that wage. The multiplicity of employment contracts, the differing amounts of wages therein, and whether the period of work under this contract is regarded as continuous or separate. No effect on that obligation. The reason: it is a debt owed by him, which he pays in the precise amount agreed for the period claimed, and not for other periods. - The appellant’s contention that his consent to the reduction of his wage in the employment contract resulted from the respondent’s dominance, without submitting evidence thereof. An unsupported defence. - The worker’s conscription and its effect:-
