State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Bank transfer. Its definition: the bank's posting of an amount from one customer's account to another account at his request. - The beneficiary's submission of the transfer order to the bank instead of the applicant. Its effect. The applicant may not revoke the transfer order except in the event of the beneficiary's bankruptcy. - The beneficiary's right against the bank is independent of the latter's relationship with its customer, the applicant. Its implication: the bank incurs liability for delay in executing the transfer order if that delay causes damage to the beneficiary.
