Acceptance of a cheque as payment to settle the original debt. Payment conditional upon its value. Non-fulfillment of the condition. Its effect. The creditor regains his right to claim against his debtor. The holder's resort directly to an action claiming the original debt without first presenting the cheque to the drawee bank to establish the inability to collect its value. A judgment declaring the action inadmissible. No error.
