Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 957

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Exclusion of the applicable provisions of foreign law is impermissible unless they contravene public policy or morals in Kuwait, affect the entity of the State, or concern a public and fundamental interest of the community. Example of what does not fall within contravention of public policy or morals: the difference between the Jordanian compulsory insurance system, in its provisions specifying which passengers of vehicles causing the accident are excluded from third parties and are not covered by compulsory insurance, and the provisions of Kuwaiti law.
