Kuwait Court of Cassation principle number 979

State of Kuwait · Commercial and Labour — Volume 9 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Specifying the condition concerning speed, driving against the direction of traffic, and passing a traffic light. In a manner entitling the insurer to recourse against the insured. As reasonable conditions that do not conflict with the insurance contract or public policy and pursue the legitimate desire to define the scope of liability by excluding certain situations to make the risk more probable. The necessary consequence of the presence of these conditions in the policy is that the insurer has a direct action independent of the action by subrogation to the injured party.
