Article 519 of Civil Code

1 - The provisions of Article (942) shall apply to a sale by a person suffering from death illness. 2 - Nevertheless, these provisions shall not apply to the detriment of a third party acting in good faith if that third party has acquired, for consideration, a right in rem over the thing sold. Article (519 bis) (1) Salam is a sale with deferred delivery for an advance price. Article (519 bis a) (2) The subject matter of salam must be known as to genus, type, quality, and quantity, must be capable of having its quality precisely determined by description, and must be capable of existing when the term falls due. Article (519 bis b) (3) The capital must be known to the contracting parties and must be paid at the time of contracting. Article No. (519 bis c) (4) When the date for performance in respect of the subject matter of salam falls due, it must be delivered at the agreed place. If there is no agreement, it must be delivered at the place where the contract was concluded. Article (519 bis d) (5) If delivery of the subject matter of salam is impossible because its genus is unavailable when the term falls due, the salam purchaser may rescind the contract and recover the capital.
