Article 668 of Civil Code

If the contractor delays commencing or completing the work to such an extent that there is absolutely no prospect of his being able to perform it properly within the agreed period, or adopts conduct indicating his intention not to perform his obligation, or commits an act capable of making performance of that obligation impossible, the employer may request rescission of the contract without waiting for the delivery date to fall due.
