English translation
If the accused sentenced to a penalty dies before the expiry of the period for appeal, or before the appeal lodged by him is decided, his death shall result in the lapse of the first-instance judgment and the extinguishment of the criminal action against him.

إذا توفي المتهم المحكوم عليه بالعقوبة قبل ان ينقضي موعد الاستئناف، أو قبل
الفصل في الاستئناف المرفوع منه ، ترتب على وفاته سقوط الحكم الابتدائي وانقضاء
