Article 347 of Jaafari Personal Status Law

The endowed asset must satisfy the following conditions: 1- The asset must actually be owned by the endower; an endowment of another’s property is therefore invalid. 2- The asset must be capable of ownership; a Muslim’s endowment of a pig or instruments of amusement, for example, is therefore invalid, even for an unbeliever. 3- It must be something from which benefit can be derived while its substance remains, and which can be taken into possession and delivered; an endowment of cash or of an unspecified thing is therefore invalid. 4- No right of another may have attached to it; an endowment of a mortgaged asset is therefore invalid.
