Article 310 of Personal Status Law

A- Where the grandfather inherits together with full brothers and sisters or paternal half-brothers and half-sisters, he shall have two situations: 1- He shall share with them as a brother if they are males only, males and females, or females made residuary heirs together with Law Index 1175 Home Page Personal Status Law Law No. 51 of 1984 concerning Personal Status female inheriting descendants. 2- He shall take the remainder after the fixed-share heirs by way of residuary inheritance if he is with sisters who have not been made residuary heirs by males, or with female inheriting descendants. B- However, if sharing, or residuary inheritance in the foregoing manner, deprives the grandfather of inheritance or reduces his share below one-sixth, he shall be regarded as a fixed-share heir entitled to one-sixth. C- Paternal half-brothers or half-sisters who are excluded from inheritance shall not be counted in the sharing. Book Three Exclusion from Inheritance
