Article 330 of Personal Status Law

If a man dies leaving his wife or a woman observing a waiting period from him, her unborn child shall not inherit from him unless born alive within at most three hundred and sixty-five days from the date of death or separation. An unborn child shall not inherit from anyone other than its father except in the following two cases: First: That it is born alive within at most three hundred and sixty-five days from the date of death or separation. If its mother was observing a waiting period following death or separation, and the decedent died during the waiting period. Second: That it is born alive within at most two hundred and seventy days from the date of the decedent's death, if it is from a marriage subsisting at the time of death.
