A- Withdrawal from inheritance is an agreement among the heirs to exclude some of them from the inheritance in return for specified consideration. B- If one heir agrees to withdraw with another heir, the latter shall be entitled to his share and shall take his place in the estate. C- If one heir agrees to withdraw with the remaining heirs, and the consideration paid to him is from the estate, his share shall be divided among them in proportion to their shares in it. If the consideration is paid from their own property, and the withdrawal agreement does not specify the manner of dividing the withdrawing heir's share, it shall be divided among them in proportion to what each paid. أ- التخارج هو ان يتصالح الورثة على اخراج بعضهم من الميراث على شيء معلوم.
ب- إذا تخارج أحد الورثة مع آخر منهم استحق نصيبه ، وحل محله في التركة.
ج- وإذا تخارج أحد الورثة مع باقيهم ، فان كان المدفوع له من التركة ، قسم نصيبه
بينهم بنسبة انصبائهم فيها ، وان كان المدفوع من مالهم ، ولم ينص في عقد التخارج
على طريقة قسمة نصيب الخارج ، قسم عليهم بنسبة ما دفعه كل منهم .
