Article 78 of Personal Status Law

a- The wife’s maintenance, from the date of failure to provide it while it is obligatory, shall constitute a debt owed by the husband, independent of a judicial ruling or mutual agreement, and shall be extinguished only by payment or release, subject to the following paragraph. b- An action for such maintenance for a preceding period exceeding two years ending on the date the action is brought shall not be heard, unless it was fixed by mutual agreement. c- If the husband does not acknowledge that mutual agreement, it may be proved only in writing.
