Article 25 of Disability Law

A person with a disability who has full legal capacity shall choose the person who will provide care for him from among the husband, wife, or relatives up to the third degree. Care for persons with disabilities who have diminished or no legal capacity shall be provided by the mother, father, husband, or wife, as the case may be, so long as they are able to provide it and attend to its affairs. If it becomes apparent that such care is unavailable, the person legally charged with it shall be one of his relatives residing in Kuwait who is capable of undertaking responsibility for caring for the person with a disability, safeguarding him, and supervising his daily affairs, in the following order: children, then grandchildren, then siblings. If there is more than one member of the same category, they shall choose from among themselves the person who will care for the person with a disability and notify the supervisor thereof. If they do not reach agreement and no one comes forward to undertake the care, the Authority shall refer the matter to the competent court to charge one of the aforementioned relatives or another person with caring for the person with a disability, or to order his residence in a social care home, according to each case and its particular circumstances.
