English translation
1 - The creditor may claim supplementary compensation in addition to default interest without the need to prove that the damage exceeding such interest was caused by the debtor through fraud or gross fault. 2 - However, if the creditor, while claiming his right, causes the dispute to be prolonged in bad faith, the court may reduce the interest, whether statutory or contractual, or decline to award it altogether for the period during which the dispute was prolonged without justification.

۱ - يجوز للدائن ان يطالب بتعويض تكميلي يضاف الى فوائد التأخير دون حاجة الى
اثبات ان الضرر الذي يجاوز هذه الفوائد قد تسبب فيه المدين بغش منه او بخطأ
قسيم .
۲ - اما إذا تسب الدائن وهو يطالب بحقه في اطالة أمد النزاع بسوء نية فللمحكمة
ان تخفض الفوائد قانونية كانت او اتفاقية او الا تقضي بها اطلاقا عن المدة التي طال
