Article 111 of Commercial Code

1 - The contracting parties may agree on another interest rate, provided that this rate does not exceed the rates announced by the Central Bank, which are determined by the Bank's Board of Directors after the approval of the Minister of Finance. If they agree on interest exceeding these rates, it must be reduced to the rates announced on the date of conclusion of the agreement, and any amount paid in excess of that amount must be refunded. - Any commission or benefit, of whatever kind, stipulated by the creditor, if it and the agreed interest exceed the aforementioned maximum, shall be deemed concealed interest and shall be subject to reduction if it is established that this commission or benefit corresponds neither to an actual service performed by the creditor nor to a legitimate expense.
