English translation
A thing may be sold where the contracting parties contemplated, at the time of the contract, the possibility of its destruction. If destruction occurs, the purchaser shall not recover the price. However, if the seller was certain of the destruction of the thing sold at the time of the contract, the sale is invalid.

يجوز بيع شيء لاحظ المتبايعان وقت العقد احتمال تلفه ، فان تحقق التلف لا يسترد
المشتري الثمن. أما إذا كان البائع واثقا من تلف المبيع حين العقد، فالبيع غير صحيح.Ask about this article
