Article 463 of Commercial Code

1 - If payment of the bill of exchange in Kuwait is stipulated in a currency not in circulation there, payment may be made in the currency in circulation there at its rate on the maturity date. If payment is not made on the maturity date, the holder shall have the choice of claiming the amount of the bill of exchange valued in the currency in circulation in Kuwait at its rate on the maturity date or on the payment date. 2 - The custom prevailing in Kuwait shall be followed in valuing foreign currency. Nevertheless, the drawer may state in the bill of exchange the rate on the basis of which the amount payable is to be calculated. - If the amount of the bill of exchange is specified in currencies bearing a common designation but whose value in the country of issue differs from their value in the country of payment, it shall be presumed that the currency of the country of payment is intended.
