English translation
The limitation of an action claiming the value of a cheque shall not prevent the holder from claiming restitution of unjust enrichment from the drawer who did not provide funds for payment, or provided them and recovered all or part thereof. This provision shall apply to the drawer if those obligated to pay the value of the cheque have recourse against him. Fourth Section Civil Claims in Cheque Offences

لا يحول تقادم دعوى المطالبة بقيمة الشيك دون الحامل ومطالبة الساحب الذي لم
يقدم مقابل الوفاء أو قدمه واسترده كله أو بعضه برد ما أثري به دون حق.
